Terms of Service
Effective March 1, 2026
These Terms of Service (“Terms”) govern your use of whiteoakfoundation.org and the services offered by White Oak Foundation (“we,” “us,” or “the Foundation”), an approved 501(c)(3) public charity (EIN 41-4830734). By using the Site, you agree to these Terms.
Our mission
The Foundation provides free professional web design, branding, and digital services to small and under-resourced churches, funded by donations from supporters. Eligibility for services is determined by the Foundation in its sole discretion based on the criteria published on the Site.
Donations
- Donations made through the Site are processed by Stripe. We do not store full payment card information.
- Donations are tax-deductible to the fullest extent allowed by U.S. law. You will receive a receipt by email for each donation; consult your tax advisor regarding your specific situation.
- Recurring donations. Monthly donations continue until you cancel. You may cancel at any time by emailing zach@whiteoakmedia.io or using the link in your donation receipt.
- Refunds. Because donations support charitable activities that begin promptly upon receipt, donations are generally non-refundable. If you believe a donation was made in error, contact us within 30 days and we will work with you in good faith.
Applications for services
Submitting an application does not create any contract or guarantee of services. We review applications based on need, mission fit, and capacity. We will respond to applications, typically within one week.
If your church is selected for services, the specific scope, timeline, and any conditions (including any ongoing hosting and maintenance arrangements) will be communicated separately and become the operative agreement between you and the Foundation.
Acceptable use
You agree not to:
- Submit false, misleading, or fraudulent information in any form on the Site.
- Use the Site to harass, harm, or impersonate others.
- Attempt to access systems, data, or accounts you are not authorized to access.
- Probe, scan, attack, or otherwise interfere with the Site or its infrastructure.
- Use automated tools (scrapers, bots) to extract data from the Site, except for standard search-engine indexing.
Intellectual property
All content on the Site — text, graphics, logos, photographs, and code — is owned by White Oak Foundation or used with permission, and is protected by U.S. and international copyright and trademark laws. You may not copy, reproduce, distribute, or create derivative works from any Site content without our written permission, except for personal, non-commercial review.
By submitting an application story or other content to us, you grant the Foundation a non-exclusive, royalty-free, worldwide license to use that content for the purpose of operating, promoting, and reporting on the Foundation’s charitable work (for example, sharing your church’s story in newsletters or case studies). We will ask for separate written permission before publishing identifiable photographs or full names of individuals.
Third-party services and links
The Site uses third-party providers (Stripe for payments, Resend for email, Google Analytics for measurement, Vercel for hosting) and may contain links to external sites. We are not responsible for the practices or content of third-party services. Their use is governed by their own terms and privacy policies.
Disclaimer of warranties
The Site and our services are provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure.
Limitation of liability
To the maximum extent permitted by law, the Foundation, its directors, officers, employees, and volunteers will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or services. Our total liability for any claim arising under these Terms will not exceed the amount you have donated to the Foundation in the 12 months preceding the claim, or one hundred dollars ($100), whichever is greater.
Indemnification
You agree to indemnify and hold harmless the Foundation, its directors, officers, employees, and volunteers from any claim, loss, or expense (including reasonable attorneys’ fees) arising out of your use of the Site or your breach of these Terms.
Governing law
These Terms are governed by the laws of the United States and the state in which the Foundation is organized, without regard to conflict-of-laws principles. Any dispute arising under these Terms will be resolved in the state or federal courts located in that state.
Changes
We may revise these Terms from time to time. Material changes will be announced on this page with a new effective date. Continued use of the Site after changes means you accept the revised Terms.
